| What you need to know about the public’s right to know |
Open government is a cornerstone of our democracy—and is advanced at the state and local levels by the provisions of the Open Meeting Law and the Public Records Law. The level of openness these laws require—and the mechanisms which enforce public access—are important to the governmental officials, counsel for governmental bodies, and members of the public and media who wish to monitor meetings and actions. The expert panel addresses the current state of the Public Records Law and the Open Meeting Law individually, as well as their interaction in the context of local and state government. Join us online as our expert panel discusses recent as well as evolving Public Records Law trends and issues. Highlights include recent changes to exemption language as well as changes to the Public Records Law regulations. The faculty discuss emerging topics and best practices including exemption claims, identifying and separating large requests from harassing requests, and strategies for responding to both. Additionally, the panel discusses relevant and important updates within the Open Meeting Law, such as what constitutes deliberation, the requirements for meeting notices and other deadlines, whether remote access to the public is required, and whether there are differences for executive meetings. Also learn what issues continue to emerge with the use of new technologies and their effects on government function and public access in the scope of both laws and especially during the pandemic and beyond. |

ANGELA M. PUCCINI is a Senior Attorney and the Compliance Supervisor for the Public Records Division of the Secretary of the Commonwealth’s Office whose practice focuses on resolving complex legal disputes as well as developing long term solutions for future problems by educating government offices, the media and the general public on the commonwealth’s public records law and other intersecting laws. As a Senior Attorney with the Division she serves as a liaison for her office and its constituents. She further handles legal questions regarding the records law and related matters from the public, media, law enforcement, and government offices as the Division’s permanent on-call attorney, a role she has held for almost 10 years. | |

JANELLE M. AUSTIN is a shareholder at KP Law, PC in Boston. Attorney Janelle Austin’s practice focuses on general municipal law and civil litigation in state and federal courts as well as administrative agencies. Attorney Austin’s experience includes public records, civil rights, representing municipalities in claims brought under the Massachusetts Tort Claims Act and 42 U.S.C. §1983, the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and data, health and personal privacy issues, as well as constitutional matters, employment law, firearms licensing, civil fingerprinting and CORI. | |

CARRIE BENEDON is Director of the Attorney General’s Division of Open Government. In that role, she leads the division responsible for ensuring that government at all levels in Massachusetts is open and accountable, consistent with government transparency laws. Previously, Carrie was an assistant attorney general in the Administrative Law Division, where she practiced administrative and regulatory law, and handled major institutional reform litigation on behalf of the Commonwealth. Carrie was a fellow in the Boston Bar Association’s Public Interest Leadership Program, and was an elected Town Meeting Member in Brookline for several years. Carrie graduated from the University of Wisconsin Law School, and worked in private practice and then at the Wisconsin Department of Justice before relocating to Massachusetts. | |

EMILIANO FALCON-MORANO is the Policy Counsel for the Technology for Liberty Program at the ACLU of Massachusetts. Emiliano was born and raised in Argentina, where he earned his first law degree at the University of Buenos Aires and a Master in Administrative Law at Austral University. Emiliano also studied abroad at Tulane University, in New Orleans and at Sciences Po in Paris, France. In the United States, Emiliano earned a Master in Laws (L.L.M.) from the New York University School of Law–where he was awarded the Vanderbilt Medal–and is admitted to the New York bar. | |
