The 2021 edition provides new guidance on a wide range of topics, including
- preparing affidavits in support of attorney fee requests;
- the use of online resources, including the MassCourts website, to aid in the collection of judgments;
- a change in the filing threshold from $25,000 to $50,000 for actions brought in District and Superior Court;
- the addition of Rule 8.1 to the Massachusetts Rules of Civil Procedure, which sets forth requirements applicable to certain consumer debts;
- new sample forms for alternative means of service and entry of default, reflecting practitioners' increased use of electronic communications to effect service; and
- a recent decision of the Appeals Court upholding a judgment creditor's levy against real property subject to the homestead exemption.
This latest edition also includes a newly added chapter on remote practice. In recognition of the expanded use of electronic communications in civil litigation, the chapter provides guidance on best practices in filings, discovery, and hearings.
