Courts routinely make determinations of whether a person will remain at liberty or be detained away from their family, friends, and the outside world, at such a high frequency that one duty attorney shouldn’t be surprised if they made up to ten bail or detention arguments in one day. The process itself feels far too fast, not considering pressure on defense attorneys to move even faster. It is hard to not ask oneself midscribble on a yellow legal pad, “is a little time to investigate too much to ask when we are talking about someone’s freedom?” The outcome of these hearings has huge ramifications that will oftentimes shape the future of the case.
